Frequently Asked Questions
Regarding Special Funds
Are there any advantages to settling my case
using an IRC Section 468(b) Qualified Settlement Fund rather than the traditional method?
An
IRC
Section 468(b)
Qualified Settlement Fund (QSF) can prove useful in those
cases where there are more than one claim to be settled or where the defense
refuses to cooperate in establishing a regular structured settlement. In the QSF,
the settlement funds are paid into a fund managed by a professional
administrator under a court order. The funds are then used to pay all costs such
as attorney fees and also to purchase a tax free annuity that can provide future
periodic payments to the claimants or to just one of them. As soon as the
funding has been paid out then the court will terminate the fund.
